As a follow up to an earlier post about the City of Los Angeles, California, enacting an ordinance patently offensive to the First Amendment, the article linked below reports that the ordinance was rightly struck down and now LA must pay the NRA over $150,000 in legal fees for the violation. Not surprisingly, city officials had no comment.
Judge Wilson ruled, “the City adopted the Ordinance ‘because of disagreement with the message’ of the NRA and with the explicit intent to suppress that message—the Ordinance should therefore be considered a content-based regulation of speech.” Content-based regulation is almost never permissible.
